Affiliate Program Terms:

These terms and conditions (the “Terms”) govern your participation in the Fragrance and Fur affiliate program (the “Program”), operated by Fragrance and Fur.

 

By enrolling in the Program, you confirm that you have carefully reviewed these Terms and agree to be legally bound by every provision contained herein.

​

Fragrance and Fur may, at any time and in its sole discretion, revise, replace, or otherwise modify these Terms. We will provide notice of such changes through one or more of the following methods:

​

1) Sending notice to the email address supplied during your Program registration;

​

2) Publishing a notice on our website at www.fragranceandfur.com;

​

3) Posting the updated Terms on the Site and changing the revision date displayed at the top of these Terms; or

​

4) Using any other form of notice that Fragrance and Fur considers appropriate.

​

Your continued participation in the Program after any changes take effect signifies your acceptance of the revised Terms.

 

By remaining within the Program, you acknowledge that the amended provisions become part of the agreement between you and Fragrance and Fur.

​

If you access or participate in the Program as an employee, consultant, or agent of a company or other entity, you represent and warrant that you hold that position and possess the authority to accept these Terms—and to bind that company or entity legally to them.

​

For purposes of these Terms, the words “you” and “Affiliate” refer to you and, where applicable, the company or other entity on whose behalf you participate in the Program.

Affiliate Registration:

To enter the Program, begin by completing the registration form available through the affiliate platform on the Site (the “Affiliate Platform”). Your participation is not confirmed until Fragrance and Fur has reviewed and accepted your application. If your application is approved, we will notify you. By applying, you agree to provide information about yourself that is accurate, current, and complete, and to keep that information truthful whenever the Program registration forms on the Site request it.

General Requirements for Acceptance: 

 

To be considered for entry into the Program, you must satisfy each of the essential requirements below. However, fulfillment of these criteria does not guarantee acceptance, which remains entirely at Fragrance andn Fur’s sole discretion.

• You must operate a website or conduct business within the United States.

• You must maintain a website and/or social media presence that demonstrates meaningful, established engagement.

• You must comply fully with every term and condition contained in these Terms.

• Your website or business must not function as a coupon, discount, or promotional-offer website or platform.

License:

​

Subject to these Terms and solely while you remain a participant in the Program, Fragrance and Fur grants you a limited, non-exclusive, non-transferable license to use its trade names, trademarks, service marks, symbols, logos, and any creative assets, copy, or discounts it makes available through the Affiliate Platform—collectively, the “Fragrance and Fur Assets.” This permission exists only to enable you to perform your responsibilities under the Program and for no other purpose.

Except for this narrowly defined license, these Terms convey no ownership, title, or other interest in the Fragrance and Fur Assets. Every use of those assets shall shine its benefit exclusively upon Fragrance and Fur. You must promptly alert Fragrance and Fur if you become aware of (a) any third party’s use of the Fragrance and Fur Assets, or (b) any third party’s use of trade names, trademarks, service marks, symbols, or logos that resemble them closely enough to suggest infringement or an attempt to pass off another business as Fragrance and Fur.

Obligations/Restrictions:

 

No Fragrance and Fur Asset may be altered, reimagined, or transformed without Fragrance and Fur’s prior written consent for each individual instance.

​

The Affiliate shall present its relationship with Fragrance and Fur truthfully and transparently at all times. In carrying out its responsibilities under the Program or these Terms, the Affiliate shall not engage in deceptive, misleading, unlawful, or unethical conduct.

​

The Affiliate shall refrain from any action or behavior that could provoke retaliation against Fragrance and Fur or any of its employees, officers, directors, contractors, or other representatives.

​

The Affiliate shall not employ improper or manipulative methods—including cookie stuffing, deceptive links, referral-link masking, redirects, repeated manual clicks, robots or automated query tools, computer-generated search requests, or the fraudulent use of search-engine-optimization services or software—to deceive or defraud Fragrance and Fur.

​

The Affiliate shall not bid on Fragrance and Fur keywords, nor on keywords that imitate or closely resemble them, unless Fragrance and Fur has granted prior written authorization.

Marketing: 
 

All marketing expenses incurred by Affiliate in connection with the Fragrance and Fur program shall be borne exclusively by Affiliate.

Before launching any marketing material, Affiliate must obtain the Fragrance and Fur team’s prior written approval; approval provided by email shall be sufficient.

​

Without Fragrance and Fur’s prior written consent, Affiliate may not create websites or advertisements that imitate, echo, or otherwise resemble the visual identity, appearance, or overall look and feel of any Fragrance and Fur property.

​

Affiliate may not include coupons, discounts, or other incentives in its marketing activities unless Fragrance and Fur has approved them in advance.

​

Affiliate may not register, create, or use any domain names, subdomains, social-media handles, or other identifiers incorporating Fragrance and Fur’s trade names, trademarks, service marks, symbols, or logos.

​

Affiliate must comply with every applicable law and regulation, including, without limitation, the CAN-SPAM Act of 2003 (Public Law No. 108-187).

​

Every email sent by Affiliate must clearly identify Affiliate in the “From” field, and no email may be designed or presented in a manner that suggests it originated from Fragrance and Fur.

​

Affiliate may not bid on keywords that contain or target Fragrance and Fur’s brand names.

 

Website and Business Restrictions:
 

Your website, business, and all marketing materials—whether created by you or by a third party acting on your behalf—must remain free from any message, text, content, data, information, software, audio, artwork, image, photograph, video, graphic, or other material that could reasonably be understood to:

​

• Break or encourage the breaking of any applicable law or regulation;

​

• Infringe, misappropriate, or otherwise violate the copyrights, trademarks, patents, trade secrets, rights of publicity, rights of privacy, or any other rights belonging to Fragrance and Fur or any other person or entity;

​

• Defame, threaten, intimidate, harass, demean, incite, target, or cause harm to any individual or entity, or be offensive, hateful, malicious, inflammatory, or otherwise objectionable;

​

• Contain obscene, pornographic, indecent, or sexually explicit material, or create, encourage, or promote pornography or bestiality;

• Display violence in a graphic, excessive, gratuitous, or needlessly disturbing manner;

​

• Present information that is untrue, misleading, deceptive, or designed to create a false impression;

​

• Store, distribute, or transmit any material containing software viruses, Trojan horses, worms, time bombs, keystroke loggers, spyware, adware, corrupted data, or any other code, file, or program crafted to interrupt, damage, disable, destroy, or restrict the operation of computer software, hardware, or networks.

Coupon Guideline

​

The Affiliate shall promote the Fragrance and Fur program exclusively with coupons supplied by Fragrance and Fur through the Affiliate Platform, ensuring that every offer carries the program’s authorized seal.

​

The Affiliate shall not use, reproduce, or promote any coupon or offer discovered on another website, platform, or third-party source in connection with the Fragrance and Fur program.

​

Authorized coupons may appear only on the Affiliate’s own website or platform. The Affiliate shall not submit, distribute, or publish any coupon code on a coupon website or third-party coupon platform
 

If a sale is generated through a coupon that was not issued by Fragrance and Fur, no commission shall be paid to the Affiliate. Nevertheless, Fragrance and Fur shall allow the customer’s transaction to stand and shall not reverse or cancel the purchase.

 

Calculation of Commissions and Payment
 

To earn commissions, you must use the exclusive tracking link assigned to you by Fragrance and Fur, in full compliance with the Link Usage Guidelines (the “Link Guidelines”). These guidelines are available by contacting info@fragranceandfur.com and are incorporated into these Terms by reference.

​

Your unique link serves as the thread connecting your advertising efforts to customer purchases, recording each time a prospective customer clicks one of your advertisements. At the end of every calendar month, Fragrance and Fur will determine the revenue generated from customer orders placed through your link during that month.

​

For subscription orders, commissions apply only to the initial purchase; recurring renewals do not qualify.

 

Approximately 30 days after the close of each calendar month, Fragrance and Fur will send you the commissions earned for that month, generally through PayPal.

​

Before monthly payments can be released, you must submit a completed tax document to info@fragranceandfur.com using the subject line: “TAX Document: [Your Refersion ID Number] & [Your Name]” (for example, “TAX Document - 1234567 Your Name”). No payment will be processed until the required document is on file.

​

​

All commissions are calculated after deducting taxes, duties, interest, penalties, late fees, comparable charges, and any amounts Fragrance and Fur is required to pay to third parties.

​

Fragrance and Fur may reverse or withhold commissions arising from canceled orders, disputed transactions, duplicate purchases, or violations of these Terms.

​

If we determine that you attempted to generate a fraudulent order, deceive Fragrance and Fur, or circumvent the Program’s rules, your participation will end immediately, and any commission connected to the misconduct may be revoked.

 

Commissions are available only for purchases made by new customers; orders from existing customers do not qualify.

 

Reporting Violations

If you become aware of any violation of any of the terms or conditions of these Terms, you are required to immediately notify us and provide us with assistance, as requested, to stop or remedy the violation. To report any violation, please contact: info@fragranceandfur.com

 

Term and Termination
 

Your journey in the Program begins once Fragrance and Fur welcomes you as an approved participant.

 

Fragrance and Fur may, at its discretion, observe or oversee activity associated with the Program, but it assumes no obligation to do so.

 

Should Fragrance and Fur reasonably determine that you have breached any provision of these Terms, your participation may end immediately, alongside any other remedies available to Fragrance and Fur.

 

Where practicable, Fragrance and Fur will first seek to notify you of the offending conduct and ask that it stop.

​

Your participation may also come to an end if:

​

1) you notify Fragrance and Fur that you wish to leave the Program; or

​

2) Fragrance and Fur independently elects to terminate your participation.

​

Affiliates may not use paid advertising of any kind to pursue Fragrance and Fur’s branded audience or branded search space. This prohibition extends to search, social media, display, shopping, and every other paid-media placement.

​

Affiliates are forbidden from bidding on, purchasing, or otherwise targeting Fragrance and Fur trademarks, brand names, related terms, or any altered, abbreviated, or misspelled versions of them.

​

No affiliate may distort the path by which a referral is measured or attempt to slip around the safeguards governing attribution. Deceptive redirects, cloaking, unauthorized incentives, manipulation of tracking tools, and violations of platform policies are strictly prohibited. Any such conduct will trigger immediate termination and the loss of all commissions.

​

If Fragrance and Fur ends your participation because you violated these Terms, every unpaid commission then outstanding will be forfeited.

​

If your participation ends for another reason—or if you choose to withdraw from the Program yourself—Fragrance and Fur will pay all commissions earned through the effective termination date within 60 days after that date.

General Terms
These Terms constitute the complete and exclusive understanding between you and Fragrance and Fur concerning the Program, gathering into a single record the parties’ entire agreement and superseding every prior or concurrent agreement, proposal, negotiation, conversation, discussion, or understanding—whether written or spoken—as well as any history of dealings or customary industry practice relating to the same subject matter. These Terms shall be governed by and interpreted under the laws of the State of Georgia, with its conflict-of-law rules set aside.

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL (A) FRAGRANCE AND FUR BE LIABLE TO YOU OR ANY THIRD PARTY FOR LOST PROFITS, LOST USE, LOST REVENUE, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATING TO THESE TERMS, NO MATTER THE LEGAL THEORY ASSERTED—WHETHER CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE—AND REGARDLESS OF WHETHER FRAGRANCE AND FUR HAS BEEN WARNED OF, OR OTHERWISE KNEW OF, THE POSSIBILITY OF SUCH DAMAGES; AND (B) FRAGRANCE AND FUR’S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR CONNECTED WITH THESE TERMS SHALL NOT EXCEED THE AMOUNTS FRAGRANCE AND FUR PAID TO YOU UNDER THESE TERMS DURING THE SIX-MONTH PERIOD IMMEDIATELY PRECEDING THE ACCRUAL OF THE FIRST CLAIM. THE ASSERTION OF MULTIPLE CLAIMS SHALL NOT ENLARGE, RESET, OR OTHERWISE CIRCUMVENT THIS LIABILITY CAP.

 

For all purposes, neither party shall be regarded as the other’s agent, franchisor, franchisee, employee, representative, owner, or partner. Their relationship shall remain solely that of independent contractors, separate entities walking parallel paths but never merging into one. Neither party possesses the authority to undertake, assume, or create obligations for the other, nor may either party make representations or warranties—whether express or implied—or otherwise bind the other party in any manner.

​

You may not assign, delegate, or transfer these Terms, or any right, title, interest, or obligation arising under them, whether through sale, merger, operation of law, or any other means, without Fragrance and Fur’s prior written consent. Any attempted or purported assignment, delegation, or transfer made in defiance of this requirement shall be void from its inception and shall carry no legal force or effect.

​

If any provision of these Terms is found to be invalid, unlawful, or incapable of enforcement under any rule of law or public policy, that provision alone shall yield, while the remaining provisions continue in full force and effect—provided that the economic and legal substance of the transactions contemplated by these Terms is not adversely altered for any party. Upon such a determination, the parties shall meet in good faith to reshape the affected provision and preserve, as closely as reasonably possible, the original intent of the parties, so that the transactions envisioned by these Terms may reach their intended destination.

You agree that our communications and transactions may travel through electronic channels and may be conducted entirely by electronic means.
